On October 15, 2018, the New York County Supreme Court granted Jaspan Schlesinger’s motion to enforce a judgment against a defendant’s ownership interest in real property located in Manhattan.
Herman, et al. v. Herman, et al. (New York County Index No. 650205/2011) concerned a brother’s scheme to defraud the firm’s client, his sister, out of her one-half interest in six prime properties in Manhattan. Jaspan Schlesinger previously obtained a judgment of $103 million and the return of our client’s one-half interest in 952 Fifth Avenue against this defendant.
Since the entry of judgment, the defendant has resisted enforcement. Jaspan Schlesinger moved the court for an order awarding its client title to the other half of 952 Fifth Avenue, still owned by the defendant, in partial satisfaction of the judgment. The defendant opposed, advocating instead for a public sale of his interest in the building. The Court granted the relief requested by the firm and appointed a receiver for the purpose of signing a deed transferring the defendant’s interest in the property to our client.
